Terms of Service

By accessing or using the Coconut AI platform, website, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

If you do not agree to these terms, you may not access or use the Services.

Coconut AI provides an agentic development platform that enables teams to provision, manage, and scale AI-powered development environments. Our Services include cloud-hosted environments, collaboration tools, task automation, integrations with third-party services, and related documentation and support.

To use certain features of the Services, you must create an account. You agree to provide accurate, current, and complete information during registration and to update your information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

You must notify us immediately at security@coconut.dev if you believe your account has been compromised.

You agree to use the Services only for lawful purposes and in compliance with all applicable laws and regulations. You may not use the Services to: violate any law or regulation; infringe on the rights of others; transmit malicious code or interfere with the operation of the Services; attempt to gain unauthorized access to any part of the Services; or use the Services to develop competing products.

We reserve the right to suspend or terminate your access if we determine, in our sole discretion, that you have violated these terms.

The Services, including all software, documentation, branding, and content created by Coconut AI, are the intellectual property of Coconut AI Inc. and are protected by copyright, trademark, and other intellectual property laws.

You retain all rights to the code, data, and content that you create, upload, or process through the Services. Coconut AI does not claim ownership of your content and will not use your proprietary code or data for training purposes.

Certain features of the Services require a paid subscription. By subscribing to a paid plan, you agree to pay all fees as described at the time of purchase. Fees are non-refundable except as required by law or as expressly stated in a separate agreement.

We may change our pricing with 30 days' prior notice. Continued use of the Services after a price change constitutes acceptance of the new pricing.

We strive to maintain high availability of the Services but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. For enterprise customers, service level agreements (SLAs) may be provided under separate agreements.

Our collection and use of personal information in connection with the Services is described in our Privacy Policy. By using the Services, you acknowledge that you have read and understood our Privacy Policy.

For enterprise customers processing personal data of EU residents, we offer Data Processing Agreements (DPAs) upon request.

To the maximum extent permitted by law, Coconut AI Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Services.

Our total liability for any claims arising out of or relating to these terms or the Services shall not exceed the amounts paid by you to Coconut AI in the twelve months preceding the claim.

You agree to indemnify and hold harmless Coconut AI Inc., its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or relating to your use of the Services or violation of these terms.

You may terminate your account at any time by contacting us. We may suspend or terminate your access to the Services at any time for violation of these terms, with or without notice.

Upon termination, your right to use the Services ceases immediately. We will make your data available for export for 30 days following termination, after which it may be deleted.

These terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising out of or relating to these terms shall be resolved in the courts located in Travis County, Texas.

We may modify these terms at any time. We will provide notice of material changes by posting the updated terms on our website and, where possible, by email. Your continued use of the Services after changes constitutes acceptance of the revised terms.
